PATERNAL ACKNOWLEDGMENTS

Acknowledgment of Paternity

The Acknowledgment of Paternity, of a child that was born abroad, can be established either by:

1. A) Act of Voluntary Acknowledgment
2. B) By Court Decision

A) Act of Voluntary acknowledgment

1) Declaring the birth of the child when both parents are Greek
Required documents:

• Notarial Act of Acknowledgment of Paternity issued from the Greek Consul or by a Notary Public in Greece; which affirms a) the fathers’ Paternity Acknowledgment b) the mother’s consent to the affirmation and c) the child’s municipal registration
• Registration of birth issued by a) at the Greek Consul based on the authentic certified foreign birth certificate with an official translation;
• Certified Family Status¹ from the municipality in Greece (of both parents if they are registered in different municipalities)
• The applicant must have identification documentation or passport

The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney c) by a lawyer duly authorized; by means of Special Power of Attorney.

2) Declaring birth of a child at the Special Civic Registry Section of a Greek mother and foreign father
Required documents:

• Notarial Act of Acknowledgment from the Greek Consul or by a Notary Public in Greece or by Act of Acknowledgment according to the laws of the country where the child was born.
• Registration of birth issued by the Greek Consul or from the Country’s authorities (where the child was born) legally certified with a formal translation²
• Certified Family Status³ from the municipality in Greece where the mother is registered;
• The applicant must have identification documentation or passport.

The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized by means of Special Power of Attorney.

3) Declaring birth of a child to a foreign mother and a Greek father

Case 1:  Acknowledging child during pregnancy

 Required documents:

• Notarial Act of Acknowledgment of Paternity from the Greek Consul or by a Notary Public in Greece or by Act of Acknowledgment according to the laws of the country where the child was born.
• Thereupon the birth is registered at the Greek Consul or at the Special Civic Registry.
• The certified Birth Certificate
• Certified Family Status⁴ from the municipality where the mother is registered. The Family Status must be issued the last six (6) months.
• The applicant must have valid Identification documentation or passport.

The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized by means of Special Power of Attorney.

Case 2: Paternity Acknowledgment after the birth of the child

The child acquires the Greek citizenship from the date of acknowledgment of paternity by the Greek father. In this case, prior to the child’s registration the competent Regional Department of Citizenship⁵ will issue a Decision on the child’s citizenship.

Thereupon, the Special Civil Registry Department will issue the acknowledgment of Paternity Report.

Case 3: Acknowledgment before Notary Public in Greece

The birth is either declared at the municipality of the Notary Public registered office or at the Special Civil Registry submitting the Notary Public Act.

Required documents:

– Original or certified copy of the notarized acknowledgment of paternity document which affirms mother’s consent;

– Birth certificate of the Greek parent issued within the last six months;

– The applicant must have valid Identification documentation or passport.

– FEE Receipts of fee paid to the local Public Financial Service (Δ.Ο.Υ) or from eparavolo https://www1.gsis.gr/sgsisapps/eparavolo/public/welcome.htm

– No fee is required if the birth is declared within the first 90 days.

– if the registration takes place between the 90^th and 180th day a fee of 5.40 euro is required to be paid at the Public Financial Service (Δ.Ο.Υ) or the fee can be paid through eparavolo: code number 3826 for 5.40 Euros.

– if the registration takes place after 180 days from the birth, a fee 15.60 euro is required to be paid at the Public Financial Service (Δ.Ο.Υ)or the fee can be paid through eparavolo: code number 3827 for 15.60 Euros.

The birth can be registered at the Special Civic Registry: a) by the parents if the child is underage b) by the interested person itself provided that she/he is 18 years of age c) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized; by means of Special Power of Attorney.

Β) ACKNOWLEDGMENT WITH JUDICIAL DECISION

1) Acknowledgment based on a ruling from a court abroad:

 Required documents:

– Irrevocable court judgment legally certified;

– Official translation of the court judgment;

– Decision of a Greek Court recognizing the decision of the foreign court as acquiring the effect of res iudicata (where necessary);

– Birth certificate⁶ of the Greek parent from the municipality. The Birth certificate must be issued within the last six months;
– The applicant must have valid Identification documentation or passport.

Fee to be paid to the Public Financial Service (Δ.Ο.Υ) See above

The birth can be registered at the Special Civic Registry: a) by the parents if the child is underage b) by the interested person itself provided that she/he is 18 years of age c) c) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized; by means of Special Power of Attorney.

 2) Judicial decision of acknowledgment of paternity by a competent Greek court

 Required documents:

– Irrevocable court judgment;

– The Service Report from the court;
– Certification from the Office of the Court which issued the decision, certifying that no ordinary or extraordinary appeal has been lodged. It must be issued  one month after the Service
Report;
– Birth certificate of the Greek parent⁷. The Birth Certificate must be issued   within the last six months;

The birth can be registered at the Special Civic Registry: a) by the parents b) by the interested person itself provided that she/he is 18 years of age c)  by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized; by means of Special Power of Attorney.
