







{"id":95405,"date":"2019-04-04T09:48:59","date_gmt":"2019-04-04T06:48:59","guid":{"rendered":"https:\/\/www.ypes.gr\/?page_id=95405"},"modified":"2020-06-30T11:27:07","modified_gmt":"2020-06-30T08:27:07","slug":"paternal-acknowledgments","status":"publish","type":"page","link":"https:\/\/www.ypes.gr\/en\/paternal-acknowledgments\/","title":{"rendered":"PATERNAL ACKNOWLEDGMENTS"},"content":{"rendered":"<p><strong>Acknowledgment of Paternity<\/strong><\/p>\n<p>The <strong>Acknowledgment of Paternity<\/strong>, of a child that was born abroad, can be established either by:<\/p>\n<ol>\n<li>A) Act of Voluntary Acknowledgment<\/li>\n<li>B) By Court Decision<\/li>\n<\/ol>\n<p><strong>A) Act of Voluntary acknowledgment <\/strong><\/p>\n<p>1) <u>Declaring the birth of the child when both parents are Greek<\/u><br \/>\n<u>Required documents:<\/u><\/p>\n<ul>\n<li>Notarial Act of Acknowledgment of Paternity issued from the Greek Consul or by a Notary Public in Greece; which affirms a) the fathers\u2019 Paternity Acknowledgment b) the mother\u2019s consent to the affirmation and c) the child\u2019s municipal registration<\/li>\n<li>Registration of birth issued by a) at the Greek Consul based on the authentic certified foreign birth certificate with an official translation;<\/li>\n<li>Certified Family Status<sup>1<\/sup>\u00a0from the municipality in Greece (of both parents if they are registered in different municipalities)<\/li>\n<li>The applicant must have identification documentation or passport<\/li>\n<\/ul>\n<p><span style=\"color: #3366ff;\"><strong>The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney c) by a lawyer duly authorized; by means of Special Power of Attorney.<\/strong><\/span><\/p>\n<p>2) <u>Declaring birth of a child at the Special Civic Registry Section of a Greek mother and foreign father<\/u><br \/>\n<u>Required documents:<\/u><\/p>\n<ul>\n<li>Notarial Act of Acknowledgment from the Greek Consul or by a Notary Public in Greece or by Act of Acknowledgment according to the laws of the country where the child was born.<\/li>\n<li>Registration of birth issued by the Greek Consul or from the Country\u2019s authorities (where the child was born) legally certified with a formal translation<sup>2<\/sup><\/li>\n<li>Certified Family Status<sup>3<\/sup>\u00a0from the municipality in Greece where the mother is registered;<\/li>\n<li>The applicant must have identification documentation or passport.<\/li>\n<\/ul>\n<p><span style=\"color: #3366ff;\"><strong>The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized by means of Special Power of Attorney.<\/strong><\/span><\/p>\n<p>3) <span style=\"text-decoration: underline;\">Declaring birth of a child to a foreign mother and a Greek father<\/span><\/p>\n<p><strong>Case 1:\u00a0 Acknowledging child during pregnancy <\/strong><\/p>\n<p><em>\u00a0<\/em><u>Required documents:<\/u><\/p>\n<ul>\n<li>Notarial Act of Acknowledgment of Paternity from the Greek Consul or by a Notary Public in Greece or by Act of Acknowledgment according to the laws of the country where the child was born.<\/li>\n<li><u>Thereupon<\/u> the birth is registered at the Greek Consul or at the Special Civic Registry.<\/li>\n<li>The certified Birth Certificate<\/li>\n<li>Certified Family Status<sup>4<\/sup>\u00a0from the municipality where the mother is registered. The Family Status must be issued the last six (6) months.<\/li>\n<li>The applicant must have valid Identification documentation or passport.<\/li>\n<\/ul>\n<p><span style=\"color: #3366ff;\"><strong>The child may be registered at the Special Civic Registry Section: a) by the mother or father b) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized by means of Special Power of Attorney.<\/strong><\/span><\/p>\n<p><strong>Case 2: Paternity Acknowledgment after the birth of the child <\/strong><\/p>\n<p>The child acquires the Greek citizenship from the date of acknowledgment of paternity by the Greek father. In this case, prior to the child\u2019s registration the competent Regional Department of Citizenship<sup>5<\/sup>\u00a0will issue a Decision on the child\u2019s citizenship.<\/p>\n<p><u>Thereupon,<\/u> the Special Civil Registry Department will issue the acknowledgment of Paternity Report.<\/p>\n<p><strong>Case 3: Acknowledgment before Notary Public in Greece <\/strong><\/p>\n<p>The birth is either declared at the municipality of the Notary Public registered office or at the Special Civil Registry submitting the Notary Public Act.<\/p>\n<p><u>Required documents:<\/u><\/p>\n<p>&#8211; Original or certified copy of the notarized acknowledgment of paternity document which affirms mother\u2019s consent;<\/p>\n<p>&#8211; Birth certificate of the Greek parent issued within the last six months;<\/p>\n<p>&#8211; The applicant must have valid Identification documentation or passport.<\/p>\n<p>&#8211; <u>FEE<\/u><u> Receipts of fee paid to the local Public Financial Service (\u0394.\u039f.\u03a5) or from <strong>eparavolo<\/strong> <\/u><a href=\"https:\/\/www1.gsis.gr\/sgsisapps\/eparavolo\/public\/welcome.htm\">https:\/\/www1.gsis.gr\/sgsisapps\/eparavolo\/public\/welcome.htm<\/a><\/p>\n<p>&#8211; No fee is required if the birth is declared within the first 90 days.<\/p>\n<p>&#8211; if the registration takes place between the 90<sup>th<\/sup> and 180th day a fee of 5.40 euro is required to be paid at the Public Financial Service (\u0394.\u039f.\u03a5) or the fee can be paid through eparavolo: code number<strong> 3826 for 5.40 Euros.<\/strong><\/p>\n<p><strong>&#8211; <\/strong>if the registration takes place after 180 days from the birth, a fee 15.60 euro is required to be paid at the Public Financial Service (\u0394.\u039f.\u03a5)or the fee can be paid through eparavolo: <strong>code number 3827 for 15.60 Euros<\/strong><strong>.<\/strong><\/p>\n<p><span style=\"color: #3366ff;\"><strong>The birth can be registered at the Special Civic Registry: a) by the parents if the child is underage b) by the interested person itself provided that she\/he is 18 years <\/strong><strong>of age c) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized; by means of Special Power of Attorney.<\/strong><\/span><\/p>\n<p><strong>\u0392<\/strong><strong>) ACKNOWLEDGMENT WITH JUDICIAL DECISION <\/strong><\/p>\n<p>1) <u>Acknowledgment based on a ruling from<\/u><u> a court abroad:<\/u><\/p>\n<p><em>\u00a0<\/em><u>Required documents:<\/u><\/p>\n<p>&#8211; Irrevocable court judgment legally certified;<\/p>\n<p>&#8211; Official translation of the court judgment;<\/p>\n<p>&#8211; Decision of a Greek Court recognizing the decision of the foreign court as acquiring the effect of res iudicata (where necessary);<\/p>\n<p>&#8211; Birth certificate<sup>6<\/sup> of the Greek parent from the municipality. The Birth certificate must be issued within the last six months;<br \/>\n&#8211; The applicant must have valid Identification documentation or passport.<\/p>\n<p><strong>Fee to be paid to the Public Financial Service (<\/strong><strong>\u0394<\/strong><strong>.<\/strong><strong>\u039f<\/strong><strong>.<\/strong><strong>\u03a5<\/strong><strong>) <\/strong>See above<\/p>\n<p><span style=\"color: #3366ff;\"><strong>The birth can be registered at the Special Civic Registry: a) by the parents if the child is underage b) by the interested person itself provided that she\/he is 18 years of age c) c) by a duly authorized third party; by means of notarized Special Power of Attorney d) by a lawyer duly authorized; by means of Special Power of Attorney.<\/strong><\/span><\/p>\n<p><strong>\u00a0<\/strong>2) <u>Judicial decision of acknowledgment of paternity by a competent Greek court<\/u><\/p>\n<p><strong><em>\u00a0<\/em><\/strong><u>Required documents:<\/u><\/p>\n<p>&#8211; Irrevocable court judgment;<\/p>\n<p>&#8211; The Service Report from the court;<br \/>\n&#8211; Certification from the Office of the Court which issued the decision, certifying that no ordinary or extraordinary appeal has been lodged. It must be issued\u00a0 one month after the Service<br \/>\nReport;<br \/>\n&#8211; Birth certificate of the Greek parent<sup>7<\/sup>.
